海上油污损害赔偿的国际法调控

Intervention of International Laws into Compensation for Losses Caused by Oil Pollution on Sea

经济发展对石油能源需求的增加,不管是在海上石油的开采还是石油运输业的发展,不可避免带来海洋石油污染问题的日益严峻,进而引发一系列油污损害赔偿的法律问题。从国际法的视角,梳理了有关海上油污损害赔偿的国际法调控的现状,阐释了国际油污公约在中国国内的适用,同时分析了海上油污损害赔偿的国际法调控的不足并提出几点展望。

Sea pollution is becoming prominent as a result of growing oil exploitation and transportation to accommodate increasing needs of economic development, and making compensation for losses caused by oil leakage has been triggered. This paper analyzes the status quo of application of international laws to those cases, and argues for their suitability in Chinese context. But the paper also notices problems in practice, and puts forwards some countermeasure.
