This paper reports the recent legislations and development on the institutional open access mandate in the US. The U.S.＇s emphasis on the open access exemplifies its respect to knowledge fairness and public knowledge right. The academia and higher education in the U.S. have nurtured a favorable environment for the institutional open access. The U.S. experience shows that China should be more active on the open access mandate.
