Research Review of the Allocation of Burden of Proof in Administrative Proceedings

行政诉讼举证责任是行政诉讼证据制度的核心问题,举证责任的分配直接关系到行政诉讼价值目标的顺利实现。本文通过文献研究的方法从被告举证责任的分配、原告举证责任的分配、举证责任分配困境方面对现有的成果进行梳理,为后人深入探讨行政诉讼举证责任分配问题开辟一条快速进入其前沿领域的途径。

The burden of proof in administrative litigation is the core problem in the evidence system of administrative litigation, and directly affects the smooth realization of the value target of administrative litigation. In recent years, there are a lot of valuable research results in the field. Through literature research methods, this article tries to classify the distribution of burden of proof on the accused, the allocation of burden of proof on the plaintiff, the allocation of the bur- den of proof difficulties on the existing achievements, so as to open up a quick access to its frontier way for the later gen- erations to deeply explore the burden of proof in administrative litigation.
