On the Constitutionalism with Chinese Characteristics

宪政是指人类创设的控制公权力行使,保障人权,保护公权力相对人权利、自由,体现现代政治文明的一种国家和社会治理机制。所谓"中国特色宪政",是指既立足中国基本国情,又反映宪政普适性要素的国家和社会治理机制。中国特色宪政要求中国共产党依法执政,在宪法和法律范围内活动;要求政府依法行政,以宪法、法律规范和控制行政权的行使;要求法院、检察院独立行使审判权和检察权,排除一切国家机关、组织和个人对司法的干预。坚定地走中国特色宪政之路是实现中华民族伟大复兴的中国梦的必须。我们对此不能有任何犹豫彷徨,不能把宝贵的时间耗费在姓"资"姓"社"的无谓争论中。空谈误国,我们应奋起行动,排除一切干扰,推进中国特色宪政,实行中国特色宪政。

Constitutionalism refers to a national and social governance mechanism created by human,to control the exercise of public authority,to protect human rights,to protect the rights and freedom of the counterpart of public power,and to reflect modern political civilization. The so-called'C hinese characteristic constitutionalism 'refers to the governance mechanisms that are not only based on China's basic national conditions,but also reflect constitutional universal elements. To realize Chinese characteristic constitutionalism requires the Communist Party of China ruling according to law and within the scope of the constitution and the law,requires the government administrating according to law and the executive pow er being regulated and controlled by the Constitution and the laws,and requires the court and procuratorate exercising judicial power and procurator pow-er independently,and eliminating the interference to judicial activities by any state organs,organizations and individuals. T o achieve the great rejuvenation of the Chinese dream must firmly take the road of Chinese characteristic constitutionalism. There cannot be any hesitations and we can not spend our precious time on the senseless argument on its'capitalism 'or 'socialism 'nature. Since empty talks do harm to our country,then we should rise up,to eliminate all interference,to promote Chinese characteristic constitutionalism,and to implement the constitutionalism with Chinese characteristics.
