论《环保法》的特殊功能及其提升

Special Functions of Environmental Protection Law and Their Upgradation

当前《环保法》修改的困局,凸显辨析《环保法》特殊功能的必要。笔者主张改造现行《环保法》,使其具备并发挥以下三项特殊功能:(一)为环保事业奠定法律基础和组织保障;(二)规范和约束有关环境的政府行为;(三)规定一般性环境监管制度。这三项功能都服务于环境法"为环保主体良性有效互动提供法律保障"这一总任务。经过这样的改造和提升,《环保法》将成为一部以为环保事业奠定基础和规范及制约有关环境的政府行为为主要功能的法律。

The current deadlock of the amendment of Environmental Protection Law of the People＇s Republic of China necessitates an identification of the special functions of the law. This paper proposes that the law be reformed so that it can lay down legal foundation and provide organizational safeguard for the cause of environmental protection, regulate and restrict environment related administrative actions, and provide general environmental regulation systems, which can serve for the general task of the law--to provide legal safeguard for effective interactions among the major players in the cause of environmental protection. After this reform, the law is to become a law which can regulate and restrict environment related administrative actions.
