规范和制约有关环境的政府行为:理论思考和制度设计

Regulation and Restriction of Environment Related Administrative Actions: Theoretical Thinking and System Design

改革开放以来,我国环保立法大发展,但环境状况不断恶化,环保领域的"政府失灵"问题十分突出。对此,上海交通大学环境资源法研究所举办了第二期环境法网上研讨会,围绕"规范和制约有关环境的政府行为"进行了比较深入的探讨。与会学者分析了我国地方政府环保履职的现状、存在的问题及其深层原因,提出了克服地方政府角色多元对环境法实施的不利影响、中国环境法的规范主义进路、解决政府环保履职的激励不足、加强环保主体的互动保障等理论观点;另一方面从具体的制度设计出发,提出了完善干部政绩考核制度、明确环境行政不作为的法律责任、建立政府环境信息公开义务的法律追究机制以及发挥第三方主体的监督作用等建议。这些观点和建议不仅对全国人大正在进行的修改《中华人民共和国环境保护法》的工作具有重要的参考价值,而且给我国环境法学研究带来了新思路和新思考。

The regulation and restriction of environment related administrative actions is an important legislation proposal and academic viewpoint of the Environmental and Resources Law Institute （ERLI） of Shanghai Jiao Tong University in recent years. An in-depth discussion of this topic was conducted in the Second Internet-Based Symposium held by ERLI recently. Most of the participants of the symposium were well-known young scholars of environmental law. Their speeches either focused on theoretical reflection or practical system design, all of which were well prepared and contained expertise. These speeches are of great reference value for the current work of the National People＇s Congress on amendment of the Environmental Protection Law of the People＇s Republic of China.
