特殊商标及其立法保护

Special Trademarks and Relevant Protection

本文对几种特殊商标及其立法保护进行了阐释，其中有些商标是我国现行立法中没有涉及的，还有些商标虽然在法律中有所规定，但保护不够完善。对这些特殊商标权客体的研究有助于我国相关立法的成熟。

This article concisely introduces several special objects of trademark right and relevant legal protection for them. Some of them are excluded from Chinese trademark legislation, and others are not fully protected even they are stipulated in China's law. The author purposely proposes them in order to arouse the higher attention of scholars and lawmakers, so that something will be done to reform and complete Chinese trademark system.
