WTO规则下碳关税法律问题分析

Legal Analysis of Carbon Tariffs Under the Rules of WTO

文章从WTO规则的核心价值、WTO的根本性规则、WTO的一般性规则和WTO的特别性规则四个层次分析了WTO规则与碳关税的关系,认为碳关税与WTO的自由贸易与公平贸易的核心价值存在冲突,不符合WTO根本性规则的要求,违反了最惠国待遇原则、国民待遇原则和环境保护一般例外等WTO的一般性规则,也违反了《技术性贸易壁垒协议》和相关部长级会议决议,容易引起各国之间的贸易摩擦,是典型的国际贸易绿色壁垒。

Under the core values of the WTO rules, the relation between WTO rules and carbon tariffs is analyzed with the basic rules, general rules and special rules of WTO. It is be- lieved that carbon tariffs and the core value of WTO＇ s free trade and fair trade conflict with each other. This disagrees on the basic rules of WTO, and violates the principles of most-fa- vored-nation treatment,national treatment, and environmental protection. This also violates TBT and related ministerial meeting resolution and hence is easy to cause international trade friction.
