机动车交通事故损害赔偿执行难原因及对策研究

A Research on the Causes and Countermeasures on Difficult Enforcement of Traffic Accidents Damages of Motor

在现阶段,肇致机动车交通事故损害赔偿案件执行难的原因是多元性的,既有来源于相关国家机关方面的原因,也有源于申请执行人和被申请执行人方面的原因。解决问题的对策包括:提高法院执行主体的能力、完善相关法律条文、建立与公安机关密切协作的联动机制、增强保险公司理赔的效力、提高申请执行人和被执行人的法律及道德素养、建立机动车交通事故受害人司法救助基金。

At the present, traffic accidents damages of motor are difficult to enforce and the reasons are di- verse. The state organ, the applicant for enforcement and the award debtor have the responsibility. The counter- measures to solve the problem are briefly as follows ： to improve the ability of the court enforcement ; to consummate related law article; to establish closer linkage mechanism with the public security organs ;to enhanced the validity of claims of insurance company： to improve the applicant for enforcement and the award debtor＇s moral and legal quality： and to establish social assistance funds for road traffic accident.
