摘要
目前,我国保障房可分为产权型保障房和租赁型保障房,现有立法重点关注保障房的分配,却忽视其退出及交易,这是制约保障房制度顺利实施的症结所在,构建公平、合理的退出机制是使保障房回归"公共产品"价值属性之保证。在分析保障房退出机制现存问题的基础上,提出制定统一的保障房退出事由和采取多元化的退出措施;重塑产权型保障房的物权属性、建立政府回购体系并推行其交易的"内部循环";同时,构建保障房的长效监控机制作为相应的配套措施。
At present, the affordable housing can be divided into ownership type and leasehold type of afford-able housing in China. The existing laws pay more attention to the distribution of affordable housing, but ignore the withdrawal and transaction. It's the main reason of restricting the smooth implementation of the institution of affordable housing. To establish a fair and reasonable exit mechanism of affordable housing can assure the affordable housing going back the value attribute of"public products". Based on analyzing the problem of exit mechanism of affordable housing, the authors formulate the unified causes of withdrawal and take the diversi-fied measures of withdrawal;remodel the nature of real right, set up the system of government repurchase, and carry out the"internal circulation"of transaction;meanwhile, construct a long and effective monitoring mecha-nism of affordable housing as supporting measures.
