美国社区检察制度研究——兼谈对我国的借鉴意义

社区检察是美国检察机构在应对日益严重的犯罪问题过程中所采取的一种以社区为导向的检察策略。社区检察究竟是检察机构工作模式的转变,还是已经形成了一种新的制度,学界争议颇大。文章将通过对社区检察制度的起源,理念和构成要素、社区检察制度与传统检察制度的区别及其制度功能的转变等问题的探讨,为我国对我国检察制度改革提供相关的理论依据。

Community prosecution is a kind of community oriented strategy to fight against serious crimes in the whole system of prosecution. It is debated in academic circles whether it is the transformation of working patterns or a new system. On the basis of the origin, concept and elements of the community prosecution sys-tem, the author explores the difference and transformation in function between community prosecution system and the traditional prosecution system, to provide theoretical basis for the reform of prosecution system in chi-na.
