摘要
刑法介入产品质量监管的必要性源于产品质量法的局限性。我国产品质量监管中的实际问题是行政执法机关对制售伪劣商品犯罪行为的"以罚代刑",其根源在于我国立法对产品质量监管中行政权与刑事司法权之间界限标准的不合理,单一的数额标准为行政执法机关"以罚代刑"提供了制度空间。本文认为,要想从根本上解决问题应当去除"以数额入罪"的模式,选择"立法定性、司法定量"的定罪模式,将制售伪劣商品行政违法行为变为轻罪,并配置单一的罚金刑。
The necessity of Criminal Law's involvement in product quality regulatory stems from the limitations of Product Quality Law,but criminal mechanisms should orderly convergence with the administrative mechanisms in the Product Quality Law.Our actual problem in monitoring the products quality is that administrative penalties replace the criminal mechanisms illegally,and the main causes of the problem is that China's legislation about product quality supervision establish unreasonable boundaries standard be- tween executive power and criminal jurisdiction,the only standard is the amount of crime which provides administrative departments an institutional "crime room".To solve the problem fundamentally,we should select the mode of "Legislation deciding Incrimination and Judicature deciding Verdict", the production and sale of shoddy goods administrative violations should be transformed into "Misdemeanor" with single criminal fine.
