微博侵权是一种新型的侵权模式,具体表现为抄袭、转发、"恶意抢注昵称"、发布虚假信息等形式。微博隐匿的传播特性,网络环境混乱,管理机制尚不健全,网民素质较低,没有谨言慎行的习惯,导致用户对侵权无所畏惧。要加强网络立法与技术监管,强化运营商的监督义务,推进微博实名制,使微博在法制化的轨道上健康发展。

Microblog infringement has become a new infringement mode with such forms as plagiarizing, retransmission, cy bersquatting and publicizing false information. There is no fear for users to infringe for the hidden nature, the con- fusing network environment, the imperfect management mechanism as well as the low quality and careless behaviors of netizens. For healthy and legal development of microblog, we should network legislation and technical supervision, increase operators＇ mo- nitoring obligations and the real-name system.
