摘要
劳动合同的变更是劳动合同履行中频繁出现的情况,《劳动合同法》强调变更的书面形式,而最高人民法院的司法解释四则承认了口头变更的效力。从劳动合同的属性看,作为典型的不完全契约过分强调书面形式与社会实践有悖。但在承认口头形式的同时,要求一个月的履行期限,是否是在《劳动合同法》之外创设出了新的撤销权?本文从劳动合同的属性出发,探讨劳动合同变更的法律规制。
During the performing of labor contract, the contract changes frequently. The Labor Contract Law stipulates that all the changes should be in written, while the new Interpretation (IV) confirms the validity of oral contract. From the nature of the labor contract, as the typical incomplete contract, if the law overemphasizes the written formal that would contrary to the reality. But when the interpretation confirms oral contract and has to perform more than one mouth, whether the interpretation creates the new rule of the right of claiming cancellation. This paper will study the legal regulation of the alterations to labor contract, from the nature of employment agreement.
