中美研发创新联盟法律环境比较研究

Comparative Studies on Law Environment of Sino-US Research and Development Innovation Alliance

在以创新为动力的大背景下,研发创新联盟已经成为世界各国广泛运用的技术创新模式。目前,美国是全球科技合作创新立法最完善的国家,制定了一系列推进产业研究合作的法律法规,为合作创新联盟发展创造了良好的法治环境。本文基于研发联盟与反垄断法的冲突,比较美国与中国研发联盟的法律体系,指出中国研发联盟法律存在的不足,同时提出相关政策建议。

In the background of innovation, research and development alliance has become a mode of technological innovation adopted by many countries, of which America is the best for it has made some laws and regulations to create a better environment of legislation. According to research and development alliance and anti -monopoly law conflicts as well as different Sino- US legal systems, some deficiencies are pointed out in China5 research and development alliance law and at the same time some suggestions are proposed.
