The Inspiration to Chinese Legal Construction by Aristotle's Legal Thinking

亚里士多德于公元前326年完成的伟著《政治学》中完整的阐释了实现法治的具体路径,他强调依法治国的法律必须是良法,提倡法律的神圣权威以及法治优于人治的社会观念对西方法治思想的发展有着极其深远的影响。本文通过对亚氏法治思想体系的解读,认为当前中国法治建设中培育市民社会是实现法治的社会文化基础,而良法的确立也必须是在本土资源自然演进的基础上实现的。

Aristotle had expounded the concrete ways of realizing rule of law in the book Politics in 326 B.C. He stressed that the law to run state affairs must he good law, to advocate the holy authority of law and the rule of law is supreme the rule of human. These of his ideas have far-reaching impact on the development of western legal thinking. This article ex plores Aristotle＇s legal thinking system, pointing that fostering civil society is the social and cultural foundation to realize rule of law in the present China legal construction, while to establish good law must he realized by the natural evolution foundation of local resources.
