我国低碳产业发展在政策法律机制方面的不足与完善

Policy and Law Mechanism for the Development of Low- carbon Industry:Deficiency and Perfection

我国在低碳产业发展方面形成了初步的法律规制体系和一些政策机制,但是相关低碳产业的法律规范不完善,政策性机制缺乏体系性和协调性。应通过建立产业结构优化机制、完善低碳产业新技术的创新研发支持机制等,构建多层次的政策机制;通过将政策上升为立法,完善碳排放权交易、制定低碳产业示范区建设规划和碳金融立法等,进一步完善现有的能源法律体系,深化产业规划、激励、引导政策,制定和完善相关法律,以建立完整的低碳产业发展的政策和法律机制体系,促进我国低碳产业的发展。

There are some preliminary legal regulation and policy mechanism for the development of low- carbon industry. However,the legal norm is imperfect and the policy mechanism is unsystematic and lack of harmony. We should set up a optimization system for industrial instructure,a supporting system for new technique and a multi-layered policy mechanism; we should change the policy into the law,set out constructing planning for demonstration area,deepen related laws about industrial planning,encouraging and guiding.
