跨越李斯特鸿沟:一场误会

Crossing the Liszt Gap:a Misunderstanding

所谓跨越李斯特鸿沟,其实是一场学术误会。它只不过是罗克辛为论证其重构刑法体系的正当性而选择的一个口号。真正的李斯特鸿沟,旨在坚守形式理性、恪守罪刑法定,不能也不应被跨越;而罗克辛所谓的跨越李斯特鸿沟,实际上是致力于犯罪论体系的实质化、规范化,这一主张与李斯特本人在刑法与刑事政策关系上的立场并不相悖。虽然罗克辛以跨越李斯特鸿沟为口号所建构的初创期的目的理性犯罪论体系并不成功,但这并不意味着讨论李斯特鸿沟问题没有意义。中国刑法学正浸淫于浓厚的实质理性色彩之中。为了坚守形式理性,实现罪刑法定,需要积极推动中国刑法学向刑法教义学转型,努力建构起一个可以接受刑事政策的引导但同时又能对刑事政策的考量进行有效约束的刑法体系。

The so-called crossing the Liszt Gap is actually an academic misunderstanding. It is merely a slogan chosen by Claus Roxin to demonstrate the legitimacy of his reconstruction of the criminal law system. The real Liszt Gap is aimed at adhering to formal rationality and the principle of legally prescribed punishment for a specified crime and there cannot and should not be crossed. In contrast, Roxin＇ s so-called crossing the Liszt Gap is actually aimed at the substantiation and standardization of the system of crime theory, which is not contradictory to Liszt＇ s position on the relationship between the criminal law and criminal policy. The fact that the purposive-rational crime theory system constructed by Roxin under the slogan of crossing Liszt Gap is not successful does not mean that discussing Liszt＇ s Gap is meaningless.
