走出去战略下中国海外投资审核制度协调问题研究

On Coordinating China's Overseas Investment Approval System Under the Background of Going-out Strategy

"走出去"战略的进一步推进要求建立更加高效、安全的海外投资审核制度来协调国际国内两个市场,而中国海外投资审核制度尚存在着审核体制不协调、法制体系不健全、具体制度相冲突等问题,应当加强协调,建立多部门的联合审核机制,进一步提高立法层,完善立法体系,加强法律制度的协调。

Improving ＂Going-out strategy＂ further requires our government to establish a more simple and ef- fective overseas investment review system to coordinate the international and domestic markets. China＇s overseas investment review systems are unreasonable, the administrative system is not perfect, the legal system is not sound, and the specific legal articles are uncoordinated. We should establish a multi-sectoral joint review mecha- nism, improve the legislative layer , perfect the legislative system , strengthen the coordination of the legal arti- cles.
