绝句“亭亭画舸系春潭”著作权小议

绝句"亭亭画舸系春潭"是宋代颇负盛名的诗歌,传诵者众。然自宋迄今,关于该诗著作权的归属问题却一直争论无定。要之,有"郑文宝说"、"张耒说"、"孙冕说"三种意见,惜皆无有力的文献佐证,多为口耳相传之辞。在梳理相关历史文献的基础上,从文献记载的时效性及诗歌风格的异同性角度入手考察,该诗应为郑文宝所作。

＂Ting Ting Hua Ge Ji Chun Tan＂, is a very famous poem in Song Dynasty, but from Song Dynasty to the present on its copyright ownership remains uncertain. So far there are three ownerships, either by Zheng Wen-bao, Zhang Lei or Sun Mian, yet pitiably there lack solid evidence as a result of word-of-mouth communication. Therefore, the present paper, based on the related literature, discusses the issue in the light of the timing in the documentary recording and the similarities and differences in the poetic style and concludes that the poem should be written by Zheng Wen-bao.
