Legal Suggestions for Enforcement of DSB Reports in China

执行所涉领域广、执行难度大是中国执行DSB裁决报告的两个主要难题。作为WTO最重要的成员方,美国以实用主义为先导、国家利益为出发点,执行DSB裁决报告,以USTR为主的协调机制亦是其一大特色;欧盟以有利于联盟一体化的态度执行DSB裁决报告。立足中国国情,结合WTO成员方的执行实践,建议今后在执行DSB裁决报告时,树立国家利益至上的总体思路,建立协调人制度,并设立专家委员会配合执行,国内法院以司法克制的态度处理DSB裁决报告及相关诉讼。

When enforcing the DSB reports , there are two questions in front of China：one is that the DSB reports are related with many fields and the other is the difficulty of execution of DSB reports .As the most important member in WTO , US inclines to use pragmatism and considers the national interest as the start-ing point for execution of DSB reports .Harmonizing system which talkes USTR as the main point is con-sidered as a main characteristic .Union integration is the main reason if EU would like to carry out DSB reports .Based on Chinese conditions , combined with the practice of the most WTO members , there is no need to give DSB reports direct effect .The paper recommends China establish the general idea of the su-premacy of national interests and a coordination system with a committee of experts .Meanwhile , the do-mestic courts take judicial restraints when confronting DSB reports and related litigations .
