摘要
在价值多元的今天,价值冲突引起人们的特别关注。法律要求医生作证的义务与医生职业道德要求医生保密、维护患者隐私权义务的冲突为医生拒证权法律移植提供了可行性,也为价值冲突寻找平衡点提供契机。文章从移植的理论基础、历史渊源、现实需求、潜在问题四个层面对医生拒证权法律移植可行性进行探讨,并提出展望。
In today＇s diversified values, the value conflicts aroused people＇s special attention. From the theoretical basis of transplantation, historical origin, realistic demand, potential problems, four aspects of legal trans- plant feasibility of doctors to resist the card power were discussed, and put forward the prospect.
