改革集体土地所有权与使用权制度的构想

Conception of the Reform of the System of Collective Ownership and Right of Use of Land

我国目前存在集体土地所有权主体模糊 ,权能虚置 ;集体土地使用权内容混杂 ,不能流转等弊端 ,必须对其作根本性的改革。在坚持土地社会主义公有制的基础上 ,借鉴国有土地使用权改革的成功经验 ,取消集体土地所有制 ,代之以单一的土地国家所有制。建立和谐统一的土地用益权体系 ,严格控制改变土地用途 ,加强土地公权管理 。

In consideration of present various disadvantages in our collective ownership and right of use of land:such as the vagueness of the body,the void of functions,the confusion of right of use and the uncirculation,the author suggests a thorough reform: abolishing the system of collective ownership of land;substituting it with a uniform system of state ownership;transplanting the superficies,the right of lease in perpetuity and the easement from the Western counrties;establishing a homonious and uniform system of land use; allowing inheritance,transformation and mortgage of various right of land and implementing the statutory real rights and formal registration of land on the basis of insisting on the system of socialist state ownership,benefiting from the successful experiences of reforming the state ownership of land; right of use.At the same time,we must strictly control the changes of purposes of use,strengthen the management of public right when we introduce the Western right of land development.Such are the ideal model and the best choice in reforming the system of ownership and right of use of land in our country.
