城市、国家的国际化与偷渡犯罪的刑事政策--以北京出入境口岸偷渡犯罪数据为样本的分析

City and Country Internationalization and Criminal Policy of Illegal Immigrant Crime——Based on Samples of Illegal Immigrant Crime of Entry-exit Port of Beijing

在城市、国家的国际化的宏观背景下,传统的偷渡犯罪也经历着时代性的更新,北京出入境口岸近6年偷渡数据显示出,当代中国偷渡犯罪的性质、方法和形式都开始呈现出全新的特征和发展趋势,而传统的偷渡犯罪刑事法律体系不仅是以制裁"偷渡出境"为中心和基本思路,而且在宏观刑事政策、新型偷渡行为的制裁、偷渡犯罪与相关犯罪的衔接和偷渡犯罪刑罚设置上的滞后与缺陷日益凸显。面对偷渡犯罪中"偷渡入境"的人员总量逐渐超过"偷渡出境"的人员总量的客观犯罪态势,应当快速树立以制裁"偷渡入境"为中心的偷渡犯罪刑事政策,以此为基础重构制裁偷渡犯罪的罪名体系,完善适用偷渡犯罪的驱逐出境制度,既是未来制裁偷渡犯罪刑事立法的必然选择,也是城市、国家的国际化程度日益提高之际应当做好的法律准备。

Under the background of internationalization of city and country,traditional illegal immigrant crime has undergone profound transformation. Recent 6 year data of illegal immigration of entry-exit port of Beijing shows that illegal immigration of China appears new character and development tendency in terms of its quality,method, and pattern. However,traditional criminal legal system of immigrant crime still regards punishing Illegal Emigration as center and basic idea. Meanwhile,the criminal policy,the sanction of new illegal immigration action,the connection between illegal immigrant crime and relevant crime,and penalty of illegal immigration,has been seriously lagged. Face with the objective crime tendency of the number of Illegal Immigration gradually exceed the Illegal Emigration,we should build a criminal policy,which centers on Illegal Immigration. Based on that,we also should reconstruct the system of accusation,and complete the use of penalty of deportation of illegal immigrant crime,all of which are both as the inevitable choice for future criminal legislation of punishing illegal immigration crime and as the essential legal preparation of City and Country Internationalization.
