云产业发展与消费者隐私权保护的平衡机制研究——基于成本-收益视角 被引量:4

摘要 网络时代中信息的获取和处理成本大幅下降,促进了基于互联网提供服务的云产业的快速发展,但也增加了消费者个人信息被侵犯的风险。为了在发展云产业的同时保护消费者的个人信息隐私权,文章通过双方的成本-收益模型分析了消费者隐私保护机制建立的可行性,介绍了美国云产业发展与白宫消费者数据隐私权白皮书和美国联邦交易委员会消费者隐私权保护最终框架的监管经验,并提出了构造我国监管压力与利益动力双重驱动的消费者隐私权保护模式的建议。 Costs for information gathering drop with the development of the Internet. Cloud industry grows fast, but consumer privacy is in greater danger. To balance the two, we set forth a cost-benefit model. Costs and benefits for cloud industry to protect consumer privacy are listed in detail. A comprehensive legislation is suggested as the baseline. It is suggested that cloud industry could be more rewarding in the marketplace for their better protection of consumer privacy. The U. S. A. supervision lessons are introduced including the February 2012 White Papers on consumer privacy by the White House and the March 2012 recommendations for protecting consumer privacy by the Federal Trade Commission. A framework of protecting consumer privacy for China and some advice are given.
