摘要
有关农村土地产权制度改革的各种论点在学术界已经闹的沸沸扬扬,目前来说3种论点占据了主流,分别是土地产权的国有化理论、私有化理论以及维持现行集体所有制不变而在具体实现形式上加以改革和创新。基于我国基本国情,建议维持现行的农村土地产权集体所有制不变,并采用股份合作社形式的制度安排。股份合作社是农村产权制度改革的最佳形式,能够有效地解决"三农"问题,并将发挥重要的社会功能。
