在对法律发现的理解上,主要有两种观点:一是从法的起源角度,二是从法的适用的角度。目前,学界则更多是从司法视角去透视法律发现理论,立法立场的法律发现观鲜有提及。为此,以历史法学为切入点详细剖析立法立场的法律发现观的产生背景、观点及其影响,进而期待对该理论有个"全景式"理解。

About the legal finding, there are two mains points. One is from the angle of the law ori- gin, and the other is the application of law. At present, the academia discusses the legal finding from the judicial perspective, not from the legislative position. Therefore, it is necessary to analyze the background, viewpoint and influence about the legal finding of legislative position in detail in order toobtain the panoramic understanding.
