Judgment Rules for Antitrust Litigation About Reverse-Payment Settlements of Drug Patent and Its Enlightenment: Review of US Supreme Court Case of FTC v. Actavis, Inc., et al

在Federal Trade Commission v.Actavis,Inc.,et al.案之前,巡回法院适用"专利范围测试原则"、"快速审查原则"等不同规则审查药品专利反向支付协议的合法性,最高法院通过该案统一了认识,明确反向支付协议反垄断诉讼应适用"合理原则",该规则以及其背后的司法审查制度对于有效规制将在我国出现的反向支付协议具有一定的启示价值。

Prior to Federal Trade Commission v. Actavis, Inc., et al., circuit courts applied different roles like ＂scope-of-the-patent test＂ and＂quick look＂to justify reverse-payment settlements of drug patent. The FTC v. Aetavis case presented justices in the Supreme Court of the United States with the opportunity to reach the common understanding that ＂rule of reason＂ should be applied to antitrust litigation about reverse-payment settlements of drug patent. The said rule, together with the judicial review system behind it, is of some enlightenment values to efficient regulation on reverse-payment settlements that will appear in our country.
