摘要
美国法律意义上的不当劳动行为,主要是指企业干涉工会招徕会员等活动、言论含有威胁或陈述不实、控制企业内部劳动组织、歧视工会会员、违反诚实信用原则等行为。法律规定,由劳动关系委员会负责处理上述不当劳动行为,其救济形式一般为复职、清算积欠工资、发布临时禁令等。
According to the American law illegal working deeds is any behaviors like the enterprise inter- fering the trade union to recruit the members and anything like saying truth not like it is, any actions like con- trolling inner working organization in the enterprise. It is any actions like discriminating the working members in the trade union, and any behaviors against the principle of factualism. According to the law, the working rela- tion committee will be in charge of the issue mentioned above. The ways to interrupt the behaviors are to rein- state the employees, to make sure the owed salary and to publish the temporary ban.
