当前社会，伴随城乡建设改造步伐的不断加快，私建、乱建违法建筑现象也屡见不鲜。加之由于在违法建筑的现实查处过程中，违法建筑的处罚权并没有明确的落实到相应的执法部门，各执法部门又以执法的多因性为由，互相推诿或争权，从而严重影响了对违法建筑的及时处置。故此，在当下及时有效的明确违法建筑的查处主体，对于城乡现代化建设以及社会和谐稳定是必不可少的。

With the accelerating pace of transformation of urban and rural construction in current society, a common phenomenon of building private and illegal buildings. In addition, in the process of investigating and disposing the reality of illegal construction, punishment right of illegal construction is not entitled to the enforcement departments accordingly. And the law enforcement departments ignore their responsibilities or struggle for rights because of muhiple factors, which seriously affects the timely disposal of illegal construction. Therefore, at present, to identify the disposal subject of illegal construction timely and effectively is essential to maintain the urban and rural modernization and social harmony and stability.
