浅析价格波动引起固定价格工程合同价款调整争议

Analysis on Price Fluctuations Caused by Fixed Price Contract Price Adjustment Disputes

物价的大幅上涨导致工程建设成本的增加，部分签订固定价格合同的承包商无法因价格上涨获得发包方的价款补偿，导致双方价款纠纷。如何处理价格波动引起的固定价格合同工程价款调整已成为一个亟待解决的问题。在对比情势变更、不可抗力和商业风险异同基础上，分析认为工程合同实施过程中材料价格异常波动属于情势变更，应根据施工合同约定和法律规定予以相应调整。

Prices rising sharply will increase construction costs. Some contracts are signed in fixed price, these contractors could not get compen- sation from the employer, which will cause price dispute. How to deal with the price adjustment within the fixed price contract project has hecome an urgent problem to be solved. In this paper, on the basis of the comparison of force majeure, commercial ventures and frustration of purpose, it is believed that the unusual price fluctuation of architecture material be deemed to frustration of purpose, and the varied price should be adjusted accordingly as per corresponding agreements in the construction contract and stipulations in relevant law.
