符号学视角下的司法礼仪透视——法院文化的表达与实践

Perspective of Judicial Etiquette in the Viewpoint of Semiology——The expression and practice of court culture

当前,我国司法理论界和实务界对法官司法礼仪并未引起足够的重视。在法院文化建设中,对司法礼仪作文化比较视角上的解读是研究法官司法礼仪的前提与基础。司法仪式是符号化的表达,并由一系列象征符号组成。在符号学视野下,法官司法礼仪表现为法袍、法徽、假发、法槌、判决书等内容。在社会转型时期,在认识上,对法官司法礼仪的存在不少误区。在实践中,存在一些困境。为此,有必要对法官司法礼仪进行良性建构,即构建起顺应现代司法要求,符合本土司法礼仪文化特点,体现中国特色法制文化的法官司法礼仪架构。

Nowadays, in our country, we don＇t pay enough attention to judges＇judicial etiquette in neither the field of judiciary theory nor the practice. In the construction of court culture ,＂ it is the premise and basis of researching judges＇judicial etiquette that interpreting the judicial etiquette in comparative perspective. Judicial ritual is a symbolized expression which consists of a series of symbolic sign. In the perspective of semiology, the judges＇judicial etiquette is represented by the cape, the emblem, the hairpiece, the gavel, the written judgment and so on. In social transformation period, it exists not a few misunderstandings to judges judicial etiquette. There are also some obstacles in practice. In order to solve these problems, to construct the judges ＂ judicial etiquette benignly is necessary. It means construction a judicial etiquette framework to comply with the current judicial request, to conform to the feature of local judicial etiquette and to reflect the culture of rule by law with Chinese characteristics.
