摘要
由于农民土地财产权的残缺,地方政府通过行政力量强势推进农民集中居住,将节约出来的农村宅基地复垦,并以"增减挂钩"的形式换取城镇商业用地指标,从中获取丰厚的土地增值收益。可以说,获取土地增值收益是地方政府强迫农民集中居住的巨大动力。因此,为了确保农民集中居住的良性推进,我们必须改革并完善相关土地制度,赋予农民完整的土地财产权,从制度上根除地方政府获取土地增值收益的弊端。
Farmers'right to land property is written in Chinese constitution. Property rights are the source of civil autonomy, so giving farmers complete right to land property can let the farmers enjoy greater independent space, ensuring that farmers can eeeectively resist the local government and its officer and village cadres getting profits in the process of rural urbanization, so as to ensure that the farmers" concentrated residence is promoted healthily.
