非传统安全视角下食品安全犯罪的刑事政策及立法

On Criminal Policy for Food Safety Crime from the Perspective of the Non-traditional Security

食品安全犯罪属于非传统安全犯罪,应当立足于"非传统安全"这一新的理论视角来诠释食品安全犯罪的刑事政策。非传统安全视角下的食品安全犯罪刑事政策具有复合性和多元性特征,应当在"宽严相济"基础上"以严优先",并将食品安全的社会政策作为重心。食品安全社会政策的关键是"以行政严管为基础,以刑罚重罚为保障"。非传统安全视角下的食品安全犯罪刑事政策指导刑法将法益保护前置化,以控制食品安全这一非传统安全风险。在完善我国食品安全犯罪刑事立法时,应当进一步严密食品安全刑事法网,加大食品安全犯罪刑事处罚力度。

The food safety crime is a crime of nowtraditional security. We should introduce the new theoretical perspective to examine the food safety crime. Based on artistic conception of non traditional security, we interpret the criminal policy for food safety crime. The criminal policy for food safety crime from the perspective of non-traditional security is complex and diverse. Specifically, the premise is the criminal policy of combining leniency and strictness, taking the priority of strictness, and the center of gravity is the social policy for food safety, the key to which is based on strict administration, ensured by heavy penalty. Guided by criminal policy for food safety crime from the perspective of the non-traditional security, criminal law puts criminal legal interests in advance in order to control the risk of the non-traditional security. To perfect criminal legislation of food safety, it is required to construct strict criminal regulation and increase penal sanction.
