摘要
众所周知,登记是我国不动产物权公示的方式,但这并不意味着不动产物权公示方式只有登记这一种,《物权法》第九条的但书规定为其他公示方式的存在留下了空间。在不动产物权中,公示与登记之间不能直接划等号,即不能认为不动产物权公示就意味着只有登记。在我国,无论是在立法上,判例上还是在学理上,不动产公示方式都不是唯一的,在登记外,还有其他的公示方式。承认不动产物权登记以外的其他公示方式,对于维护交易安全和当事人合法利益有重大意义。
As we all know, the registration is the mean of real estate publication in our country, but it does not mean that the registration is the only kind of mean in real estate publication. The proviso clause in article 9 of Property law leaves space for other means of publication in real estate. In real estate rights, the publication is not equal to the registration. The idea that the real estate publication means registration is wrong. In our country, whether in legislation, case or on theory, the mean of real estate publication is not the only one. There is other means except registration. Admitting other means has great significance to the maintenance of transaction security and personal lawful interests.
