在国际投资法中,关于外资的公平与公正待遇的理论内涵,还没有形成统一的意见。近年来,公平与公正待遇的判断标准逐渐朝向良善治理的方向发展。虽然在投资条约的实践上,各国对于是否采用公平公正待遇,有着不同的态度。但从公平与公正待遇在投资条约实践上的样态分析,将公平与公正待遇纳入投资条约有其积极作用。我国作为吸引外资的大国,应该尽量避免投资者大规模运用公平与公正待遇标准而产生的纠纷。目前除了在条约中规范公平与公正待遇的内容外,充分运用各种例外情形进行免责抗辩也是重要的一环。

Although there is no agreement in the theoretical connotation of fair and equitable treatment of foreign capital in the international investment law, the standard has evolved towards the direction of good governance in recent years. In practice, countries have different attitudes towards the application of the fair and equitable treatment. However, analysis of the investment treaty practice affirms its positive role. China as a big country in attracting foreign investment should try to avoid disputes arising from investors＇ large - scale adoption of the fair and equitable treatment standard. And, at present, in addition to regulating the content of the treatment in the treaty, it is also important to make full use of various exceptions for exemption plea.
