Active Judiciary under the Background of Social Management Innovation: Practice,Reflection and Regulation

司法能动主义起源于美国,我国学者将其称为能动司法,更多反映的是一种政治愿景。与司法谦抑性相对应,能动司法意涵是在社会管理创新中,司法机关充分发挥主观能动性服务于经济、社会发展大局的一种司法理念。可是,能动司法在各地的实践中存在着盲动的问题,司法权力有向行政、社会等权力领域扩张的倾向。这既背离了司法应有的审判功能定位,又带来权力重叠和社会自治权力被侵蚀的新问题。需要对能动司法进行反思,对其权力要通过职能、原则与方法进行规制。

Judicial activism originated in American , our scholars called it active judiciary , mainly reflecting a kind of political vision . Corresponding with the judicial restraint , active judiciary means an idea that the judicial organizations give full play of initiative to serve economic and social development in the innovation of social management .However , there are blind practical actions in active judiciary and trends of judicial powers ’ expanding to executive and social powers , which not only deviates from the function of judicial trial , but also brings new problems such as power overlapping and social autonomy power ’ s being eroded .It is necessary to reflect active judici-ary and regulate its judicial power by functions , principles and methods .
