摘要
丹麦被评为"世界最清廉的国家",其有关行贿受贿的法律规定极具特色。从其行贿受贿犯罪的犯罪构成上看,其关于达到犯罪程度的标准、犯罪的主体与对象以及客观方面的行为方式等相关规定,都体现着丹麦对廉洁正义的极致追求。比较我国法律的相关规定,更明显地看出丹麦对行贿受贿犯罪刑罚处罚的各种特点,这对我国的廉政建设立法有着重要的启示作用。
Denmark was named ＂the most uncorrupt country in the world＂, the legal provisions relating to bribery with a great. From its constitutive elements of crime of bribery crime point of view, its standards concerning criminal degree, subject and object, and the objective aspect of the crime of behavior and other related provisions, reflects Denmark ultimate pursuit of honesty and justice. Comparing Chinese legal regulations, more apparent Denmark for bribery offences punished by various characteristics, construction legislation has important implications for China.
