摘要
"小产权房"背后的制度实质是什么?它反映着中国地产"非正规市场"中的私人行动者试图挤入"空间商品化"分利格局的努力。这引发了诸多困境:允许这种"挤入"将意味着政治权力被间接分割并带来连锁反应;不承认这种"挤入"就会伤害私人权利。与美国等土地私有制国家相比,中国面临不同的困局,要跳出困局需放下表面化的意气之争并作理论层面的厘清。城市化是空间商品化的过程,它冲击了中国既有的分配格局和市场结构。"空间商品化"在引发困境的同时也带来了契机:它让中国的强制力量携带了强大的资本动员能力,如果动员和强制运用得当,可以有效防止贫富分化并促进社会整合。
The informal market of real estate is a wedge without permission on policy decision of "Commercialization of Space" which challenges rules of social production on which political power is supposed to be monopoly in China. This initiates a dilemma: ratification on this challenge means a kind of segmentation on formal political power which is not allowed in a unitary system with centralization of state power for avoiding a series of chain reactions. If turn this down totally the private right on land use will become incomplete. So, it needs to be clarified in theory and abandon the battle of wills. The interesting thing is opportunities come together with dilemma that bring China a good turning point on Social integration to eliminating polarization of wealth with stronger state power and better resource mobilization.
