摘要
行政执法绩效评估指标是对行政执法进行数据统计、定量分析和绩效评估的指标。作为实现政府再造的战略工具,它不仅是技术问题,也是程序法中的规则问题,这是我们对行政执法绩效评估指标展开研究的法哲学前提。通过实证分析后我们发现,中国行政执法的绩效评估指标在设计上还存在不全面、不科学和不规范的问题,造成这一系列问题的主要原因包括两方面,一是制度的顶层设计缺位,二是具体的评估模型设计不完善。基于此,中国行政执法绩效评估指标的完善应当在加强制度建设的基础上,展开对评估模型的系统性设计。
The performance evaluation index of administrative law enforcement is a kind of data statistics, quantitative analysis and performance evaluation to administrative law enforcement. As a new thought of government management philosophy, it is not only a technical problem, but also a procedural rule. Through the empirical analysis, we find that the performance evaluation index of Chinese administrative law enforcement is still incomplete, unscientific and nonstandard. The reason that causes these series of problems mainly includes two aspects, one is the absence of the system design, the other is the design of the evaluation model which is not perfect. In order to improve the performance evaluation index of the administrative law enforcement, we should strengthen the system construction, and on this basis, we should design a systematic evaluation model.
