法庭口译员对庭审问语控制的影响

Court Interpreter's Impact on Question Control in Courtroom

刑事案件庭审的法庭调查阶段,问答是典型的交际手段。而因为庭审问答中,各方的权力不平等,利益冲突明显,作为权力较大的问话者往往会对答语进行控制,以实现问语预先设定的目标,从而有效地控制庭审进程,提高庭审效率。但在涉外刑事案件庭审中,由于法庭口译员的加入,这样的控制常常不能按问话者的意志进行。法庭口译员对问语控制产生不同程度的影响。本文以问语控制理论为视角,从问语的本原控制和过程控制两大方面,分析了法庭口译员对问语控制积极和消极的影响,试图为法庭口译员,法官和公诉人更好地配合与工作提供参考,以提高涉外刑事案件庭审的质量和效率。

Question-and-answer is a typical communication method in the court inquiry stage of the hearing of a criminal case. Due to power imbalances and fierce conflicts among different parties, a party which is vested with more power is likely to control answers via various means so as to fulfill the preset objectives of questioning. However, with a court interpreter introduced into the interaction, such control can be independent of the questioner＇ s own will. A court interpreter exerts an impact on the questioning control to a varying degree. This study is intended to probe into how a court interpreter plays a positive or negative role in transferring primary and process control of questions based on the question control theory and shed some light on better cooperation between the court interpreter and the judge and the prosecutor to improve the quality and efficiency of court hearing of criminal cases against foreigners.
