文化遗产保护与文化产业发展的冲突与协调

文化遗产保护与文化发产业发展在目的、理念以及方法和手段上存在着显著的冲突，历来都是实践中的难题。本文在阐述文化产业发展重要性的基础上，分析了文化遗产保护与文化产业发展的冲突表现，试图从文化遗产的立法保护与行政保护角度分析文化遗产保护的不足，并以此作为基点为我国文化遗产保护与文化产业发展存在的冲突提出建议，从而协调我国文化遗产的法律保护与文化产业的可持续发展。

The protection of cultural heritage and cultural industry development has significant conflicts in the objective, principle and method ways which has always been a problem in practice. Based on the importance of the elaboration of cultural industry development, the article analyzes the conflicts＇ performance of the cultural heritage protection and the development of cultural industry, tries to analyze the deficiency of the protection of cultural heritage from the legislative protection and administrative protection of cultural heritage, and makes proposals as a basis for the existing conflicts between Chinese cultural heritage protection and the development of cultural indus- try, so as to coordinate the legal protection of cultural heritage and the sustainable development of culture industry of our country.
