摘要
从类型学的角度将法院制度分为传统和现代两种基本类型，并在司法程序的独立性、理性化、公正性、刚性、和平性以及程序之主导参与主体等方面勾勒了两种类型司法程序基本特征之不同及其成因。
In this article,the author first divdes court system into two types:the traditio nal court system and the modern one.And then,by the method of typology,he deline ates the difference of basic features between two types of judicial procedures a nd discusses the cause of the difference by analysing the independence,the reaso n,the justice,the rigidity,the peace and the leading participants of judicial pro cedure.
