Tentative Remarks on the Tort against Intellectual Property at Network Setting

网络空间已不再仅仅是虚拟世界 ,通过网络对知识产权的现实和潜在的侵害正在和即将呈现于社会。对在网络环境下知识产权保护出现的新问题 ,以及由此造成的对知识产权侵权的新特点 ,进行宏观概括将成为法学界关注的热点。网络环境下的侵权行为形态的种类和对网络侵权可采用的救济方法 。

The cyberspace is no longer confined to the virtual world. The tort against intellectual property by virtue of the network, actual or potential, is emerging or will emerge in society. The macroscopic survey of the new problems with the protection of intellectual property and the new features of infringement against it at network setting is becoming the focus of attention in the academic circle. The forms of infringement and the ways of treatment under the new circumstances are also to be explored soon both in theory and in practice.
