To Understand Taiwan's Being Part of Chi na in the Light of International Law

从国家应具备的要素阐述“台湾”不是一个国家 ;从历史事实上、国际法规定上 ,阐述台湾自古就是中华人民共和国的领土 ,国际法上的主权是有不可分割性 ,中国政府目前未对台湾实际行使领土主权的事实绝不意味着台湾拥有部分主权、绝不意味着中国政府没有国际法上的权利或没有力量来实现中国的统一。

Based on the elem ents constituting a state,the paper illustrates that Taiwan is not a state.Histo rical facts and the provisions of international law tell us that Taiwan has been part of China Since ancient times.The sovereignty stipulated in international l aw has the nature of indispensability.The fact that the Chinese government has n ot exercised its territory sovereignty does not mean that Taiwan has partial sov ereignty.Nor does it mean that the Chinese government has no rights stipulated i n international law and power to realize the unification of China.
