从“坦白从宽 ,抗拒从严”向“沉默权”和“无罪推定”的转换 ,远不只是一个形下的司法操作规范层面的转换 ,毋宁说 ,这个转换乃是一个深深地触动着我们文化传统中“法”的形上理念的根本性转换。如果我们不对自己传统的形上理念进行清理和析解 ,那么 ,现代法治精神作为一种可能性 。

The change from“lenieny to those who confess their crimes and severity to those who refuse to”to“presumption of innocence ”and “mute ”,is not only a transformation which refers to some kind of concrete rules of law ,but also an essential transformation which touches deeply the ideas about“law”in our traditional culture. If we were not to deconstruct the traditional ideas, the spirit of modern legal system would not come into possibility.
