摘要
劳动争议处理机制作为调整劳动关系的最后一道防线,如果能高效运行,那么,在化解劳动关系矛盾、调整劳动关系方面的作用是毋庸置疑的。文章通过对国外劳动争议处理制度的分析和梳理,提出贯彻落实"三方原则"、修正仲裁与诉讼的衔接关系、实行裁审分离等完善我国劳动争议处理机制的设计。
As the last defense , the handling mechanism of labor dispute plays an undoubted function in resolving the conflicts in labor relations and adjusting the labor relations if it can efficiently run .Through ana-lyzing the labor dispute handling mechanism of other countries , the paper puts forward suggestions to improve the mechanism of our country such as implementation of the “tripartite principle”, modification of interface between arbitration and litigation and separation of arbitration and trial .
