摘要
我国作为CLC1992和BUNKER2001的缔约国,因"船舶"以及"油类"的定义的区分将适用不同的国际公约,船舶油污损害赔偿责任限制的公约适用具有一定复杂性。与国际公约相比,我国在船舶油污损害责任限额方面的差距巨大,这种差距直接影响到油污事故的索赔,提高船舶油污责任限额将成为完善我国船舶油污损害责任制度的步骤之一。
As China acceded to CLC 1992 and BUNKER 2001 , the regulations of the scope of application on ships , kind of oils and the limitation of liability for ships , this leads to the complexity of limitation of liabil-ity.There are huge gaps between china maritime law and international conventions in view of the limitation of liability for ships.Increasing the limitation of liability can be the way to improve the system for oil pollution damage from ships on behalf of oil pollution victims.
