摘要
现代公司发展以及公司利益与社会利益在劳动者权益上的一致性,使得企业社会责任被引入劳动立法是历史必然。我国虽已在劳动法中进行了规定,但采用企业主体"一刀切"的方式带来诸多弊端。要完善劳动立法中的企业社会责任制度,必须遵循责任主体类型化的立法思路,借鉴美国与德国公司治理模式要求,获利较大的企业履行更大的企业社会责任,最终实现优化企业社会责任配置的目标。
The development of the modem corporation and the consistency of the laborers' legal right between corporate interests and laborer interest lead to the inescapability of that the corporate social responsibility should be introduced into labor legislation. Although our country has already carried out its provision, the rigid legislative mode brought many drawbacks. We should follow the path of classification of liability subject to remedy corporate social responsibility system, and then learn from American and German model to ask the more powerful corporations undertake larger responsibility, finally we will achieve the goal of optimizing the corporate social responsibility configuration.
