人民法院司法公信力法律问题研究

On the Judicial Credibility of the Court in China

司法公信力是法治社会的重要标志。提升人民法院司法公信力是实施依法治国方略、建设社会主义法治国家、维护社会和谐稳定的前提。我国人民法院司法公信力的现状不容乐观:社会公众对法院与法官普遍缺乏信任,法院判决难以顺利执行,缠诉缠访事件居高不下,甚至出现了一些暴力袭法事件。此种现状严重影响了人民法院司法活动的正常开展,也在很大程度上妨碍了司法公正的实现与司法权威的生成。在目前的社会环境与政治语境下,应当从法院、法官与社会公众三个层面,以促进司法独立、司法民主与司法公正为核心,通过观念培养、制度改革以及规则构建等途径提升人民法院司法公信力。

Judicial credibility is the important symbol of the society with rule of law.The promotion of judicial credibility is the prerequisite of carrying out the policy of governing the country by law,constructing the socialistic country ruled by law and protecting the harmony of society.The current situation of judicial credibility is not very pleasant：the general public has not sufficient confidence in the courts and the judges,the court decision is difficult to be carried out successfully,the ceaseless events of petition occur constantly,and some violence event may happen sometimes.This situation affects the normal work of the court seriously,and obstructs the realization of judicial fairness and the formation of judicial authority greatly.It is harmful to the formation of the belief in law and the implement of the policy on ruling the country by law.Under current social surroundings and political situation,the judicial credibility should be advanced from the court,the judge and the general public through cultivating the idea,reforming the system and constructing the regulations in order to promote the independence of justice,the democracy of justice and the fairness of justice.
